Purpose
Some clients are experiencing, or at risk of, domestic, family, workplace or other violence. Their safety comes first. This policy explains how NEO protects them.
Our policy
- Safe contact. We ask how and when it is safe to contact the client, and use only those methods. We don't leave messages or send mail that could put them at risk.
- Protected information. We take extra care with the client's address and contact details, including in documents filed with a court or tribunal, and ask about options the rules allow to keep them private.
- Safe meetings. We offer meetings by phone or video, or in person at a time that is safe, and check that the client can speak freely.
- Help beyond our services. We share information about support services, such as Ontario's assaulted women's helpline, victim services and shelters, and, in an emergency, tell the client to call 911.
- Matters outside our scope. Family law matters and protection orders in family court are outside a paralegal's scope; we help the client find a lawyer or legal clinic quickly.
- Confidentiality. Information about the client's situation is shared only with their consent, or where the rules permit disclosure to prevent imminent risk of death or serious bodily harm.
- Staff awareness. Everyone at the firm knows this policy and how to respond if a client or caller is in danger.
Our own workplace
Violence and harassment in our workplace is addressed under our Workplace Safety and WSIB Policy and Anti-Harassment and Anti-Discrimination Policy.
Review
This policy is reviewed at least once a year, and whenever the Law Society's By-Laws or rules change. The principal approves every change.
