Understanding Enforcements in Ontario

Notice of Garnishment

Once you have a judgment, you can file a Notice of Garnishment with the court. This legally obligates an employer or bank (the garnishee) to pay the non-exempt portion of the debtor's income or funds directly to the Sheriff.

Writ of Seizure and Sale

A Writ allows the Sheriff to seize and sell the debtor's personal property (vehicles, equipment) or real property (homes, land) to satisfy the judgment. It also acts as a lien against the debtor's property if they try to sell it.

The 80% Rule

The Wages Act protects 80% of an employee's net wages to ensure they have sufficient funds for basic needs. However, a creditor or debtor can bring a motion to a judge to increase or decrease this amount based on hardship.
