Legal Aid in Ontario: Who Qualifies & What It Covers

Legal Aid Ontario (LAO) provides publicly funded legal services to low-income Ontarians. Understanding what it covers — and where the gaps are — helps you plan your legal strategy and find the most affordable representation for your situation.

Financial Eligibility

LAO uses a means test based on your gross monthly income and family size. General thresholds (approximate, updated periodically):

Assets are also considered. Owning a home can affect eligibility, and LAO may register a charge on your property to recover its costs if you are successful.

What Matters Are Covered?

Certificates are available for:

  • Criminal matters where there is a risk of imprisonment
  • Family law matters involving children (custody, access, child protection)
  • Immigration/refugee law (IRB hearings, deportation proceedings)
  • Mental health review board proceedings

Not covered by LAO certificates:

  • Civil matters (Small Claims Court, contract disputes, personal injury)
  • Employment law (wrongful dismissal, ESA complaints)
  • Landlord and Tenant Board matters (covered by community clinics for tenants)
  • Traffic tickets / minor HTA offences
  • WSIB / disability appeals

If You Don't Qualify for Legal Aid

You have several affordable options:

  • Licensed paralegals — For LTB, Small Claims, traffic, WSIB, criminal charges in the Ontario Court of Justice, and minor regulatory matters, paralegals charge significantly less than lawyers. Neo Legal offers fixed-fee services so you know the cost upfront.
