Why Proper Service Matters

Proper service of court documents is essential for ensuring the other party is notified of the legal action against them. Improper service can lead to your claim being dismissed or delayed.

Methods of Service

  • Personal Service — Delivering the documents directly to the individual.
  • Substituted Service — Sending the documents by mail or leaving them with an adult at the person's residence.
  • Service by Email — Some types of service can be done by email with the court's permission.
  • Alternative Methods — In some cases, you can ask the court for an order for "substituted service" such as by advertising in a newspaper or through social media.

Proof of Service

After serving the documents, you must file an Affidavit of Service with the court to prove that the papers were properly delivered.
