Withdrawal of Services Policy

Last updated: October 15, 2026

Purpose

A client is entitled to rely on us to see their matter through. This policy explains the limited situations in which NEO stops acting, and how we protect the client when we do, as the Law Society of Ontario's Paralegal Rules of Conduct require.

When we may withdraw

Only for good cause and on reasonable notice, for example:

  • a serious loss of confidence between the client and the firm;
  • the client does not pay a fee or retainer as agreed, after we have given notice;
  • the client won't give instructions, or insists on a course we can't follow.

When we must withdraw

  • The client tells us to act in a way that is dishonest, illegal or against the rules.
  • Continuing would breach the rules, for example because of a conflict of interest.
  • The client ends the retainer.
  • We are not competent to continue.

How we withdraw

  1. We tell the client in writing, with our reasons where we can give them, and enough notice to find other help.
  2. We don't withdraw at a time, or in a way, that would harm the client's matter, for example on the eve of a hearing, unless we have no choice.
  3. Where a court or tribunal requires permission or notice before a representative stops acting, we follow its rules.
  4. We tell the client about every deadline and next step we know of.
  5. We return the client's documents and property, account for any money in trust, and send a final account.
  6. We cooperate with the client's new representative so the file transfers smoothly.
The rules behind this policy

The Law Society of Ontario's Paralegal Rules of Conduct, Rule 3, including withdrawal from representation.

Review

This policy is reviewed at least once a year, and whenever the Law Society's By-Laws or rules change. The principal approves every change.
