Settlement Offers and Client Instructions Policy

Last updated: October 15, 2026

Purpose

Most disputes settle. The decision to settle belongs to the client. This policy explains how NEO handles offers to settle and the client's instructions.

Our policy

  1. Every offer is passed on. We tell the client promptly about every offer to settle we receive, whatever we think of it.
  2. We explain it. We explain the offer, its strengths and risks compared with continuing, any costs consequences under the court's or tribunal's rules, and the time it is open for.
  3. The client decides. We accept, reject or make an offer only on the client's instructions. We confirm important instructions in writing, and in the client portal.
  4. Clear terms. Settlements are recorded in writing, including what is paid, when, and what each side gives up, so there is no misunderstanding later.
  5. Releases explained. Before a client signs a release or settlement, we explain what it means, including any claims it ends.
  6. Honesty in negotiation. We negotiate firmly for our client, and we never mislead the other side or the court or tribunal.

Settlement conferences and mediation

Before a settlement conference or mediation, we discuss with the client the outcome they want and the range they would accept, and we make sure we have instructions to settle within it.

The rules behind this policy

The Law Society of Ontario's Paralegal Rules of Conduct, including the duty to keep clients informed, act on their instructions, and advise on settlement.

Review

This policy is reviewed at least once a year, and whenever the Law Society's By-Laws or rules change. The principal approves every change.
