Purpose
A missed deadline can end a claim or a defence. This policy explains how NEO identifies and tracks deadlines.
Our policy
- At the first contact. When someone contacts us with a document or a problem, we look first for any deadline: the date on a notice, claim or ticket, and the limitation period for a claim. If a deadline is close, we say so straight away, even before a retainer is signed.
- Recorded in one place. Every deadline in an open matter, including limitation periods, filing and service dates, hearings and appeal periods, is recorded in our practice system with reminders well before it falls due.
- Checked twice. Important deadlines are calculated and checked by a licensee against the governing law and rules, including how days are counted.
- Clients informed. We tell clients about the deadlines in their matter, and remind them of any step they must take themselves.
- Changes noted. When a court or tribunal changes a date, or a rule changes, the record is updated at once.
- Holidays and absences. Deadlines are covered when a licensee is away, under our Business Continuity and Succession Policy.
Limitation periods
Many claims in Ontario must be started within two years of when the claim was discovered, and some have shorter periods. Sending a demand letter or negotiating doesn't usually stop the clock. When we decline a matter, we point out any limitation period we are aware of.
Review
This policy is reviewed at least once a year, and whenever the Law Society's By-Laws or rules change. The principal approves every change.
