When to choose a paralegal or an Ontario lawyer

A licensed Ontario paralegal can provide legal services in authorized proceedings, including Small Claims Court, provincial offences, and qualifying tribunal matters. The precise issue, forum, competence, and licence restrictions still matter. A paralegal licence does not authorize every legal service.

Family law, real estate transactions, estate planning, and Superior Court proceedings generally require a lawyer, subject to any separately authorized limited licence or specific legal exception. Ordinary P1 authority should not be confused with a Family Legal Services Provider authorization. Explain your actual problem and provide the key documents before choosing representation. Ask who will handle the work, what is included, and what requires referral. The right professional is the one authorized and competent to address your particular matter.

Start with the proceeding and the work actually required. A straightforward debt claim within Small Claims Court jurisdiction may fit an authorized paralegal retainer, while an appeal from that case may require a lawyer. A tenancy question can also overlap with a sale, construction lien, or insolvency issue needing different advice. Provide the relevant documents so the assessment is based on the substance rather than the general label legal help. Authority to act and practical competence both need to be established.

Ask how a referral or change in scope will be handled if the file develops. Clarify who will preserve urgent deadlines while an appropriate professional is engaged and whether the existing retainer includes preparing the transfer materials. Check licensing information through the regulator and read the written scope and fee terms. Avoid choosing solely on a promised result or an assumption that a professional title covers every forum. The useful comparison is whether the person can lawfully and competently perform the specific work your matter requires at its current stage.
