Understanding an N12 personal use notice

An N12 says a landlord, purchaser, or qualifying family member or caregiver needs the rental unit. The legal requirements depend on the reason selected and the circumstances. Receiving the notice does not by itself authorize the landlord to remove you.

Check the termination date, fixed term, intended occupant, and compensation position. For qualifying landlord-own-use notices given on or after September 21, 2026, at least 120 days' notice can remove the compensation requirement. That exception does not apply to purchaser-own-use notices. Shorter qualifying notices remain subject to the existing compensation rules. Preserve communications and advertisements relevant to the stated intention. Obtain advice before signing an agreement to leave or assuming that every N12 has the same compensation entitlement.

Start with the actual boxes selected on the notice and identify who is said to need the home. The legal analysis may differ between a landlord's own use and a purchaser's proposed use. Keep the full lease and any renewal documents so the termination date can be reviewed against the tenancy's terms. If the landlord offers another unit or discusses compensation, preserve the precise proposal. Do not treat a general statement about the new rules as proof that the requirements for your particular notice have been met.

Your response should focus on facts relevant to the proposed occupancy and the notice requirements. Record contradictory statements, earlier requests for a large rent increase, or later advertisements, while recognizing that suspicion alone does not establish bad faith. If you decide to move, document why, when, and under which notice or agreement. Moving costs and communications may become relevant to a later dispute. An informed decision requires reviewing both your current options and how an agreement to leave could affect the evidence or remedies available afterward.
