An HRTO application calls for a structured response to the allegations and the tribunal's directions. Identify the response deadline and use the current form and rules. Procedural updates effective August 17, 2026 apply across the HRTO's caseload, so older checklists may be incomplete.

Preserve relevant records and notify appropriate decision-makers without circulating sensitive allegations unnecessarily. Address the facts, jurisdiction, and legal position carefully. Explain any accommodation process and the documents supporting the response. A bare denial or an attack on the applicant may fail to answer the actual issues. Consider conflicts, confidentiality, and any overlapping employment or tenancy proceeding. Follow the tribunal's requirements for communication and delivery throughout the case.
Create an allegation-by-allegation working response and identify the documents and witnesses relevant to each issue. Preserve both favourable and unfavourable records, including accommodation requests, policies, meeting notes, and decision correspondence. Avoid changing documents or approaching witnesses in a way that could be interpreted as pressure. If several respondents are named, assess their interests and any conflict before assuming one response or representative will suit everyone. Keep access to sensitive personal information limited to those who need it for the proceeding.
A useful response explains what occurred and the legal position taken without personal attacks. If a decision had a legitimate explanation, identify the actual evidence supporting it. If accommodation is disputed, describe the process and options considered rather than only stating that the request was denied. Follow the current tribunal directions for delivery, mediation, disclosure, and communications. An internal workplace or tenancy response does not replace the formal HRTO response. A timely, organized file helps identify genuine disputes, possible preliminary issues, and whether settlement discussions could usefully narrow the matter.
