Appealing an ODSP or Ontario Works decision

An ODSP or Ontario Works decision may require an internal review before an appeal to the Social Benefits Tribunal. The decision letter and internal review response are essential documents. Not every social assistance decision can be appealed to the tribunal.

Act promptly because short deadlines apply to internal reviews and appeals. Keep proof of when documents were received and submitted. Identify the actual issue, such as eligibility, an overpayment, or a disability determination, and organize the records relevant to it. Financial statements and medical evidence answer different questions. If you need more time or interim assistance, ask about the applicable criteria and potential consequences. An appeal should address the decision under review and the legal basis for changing it.

Read the decision letter for the date, issue, reasons, and instructions. Keep the envelope or electronic delivery record if receipt is disputed. A disability eligibility appeal may require evidence different from a disagreement about income reporting or an overpayment calculation. Build the file around the actual finding rather than submitting all available medical or financial records without explanation. If an internal review is required, preserve the request, supporting material, response, and proof of submission for the later appeal assessment.

Ask promptly about any missed deadline, request for more time, or interim assistance. Those procedures have their own criteria, and interim payments can have consequences that should be understood before proceeding. Keep reporting obligations and current benefits correspondence under review while the dispute continues. If you receive a new decision, do not assume the earlier appeal automatically challenges it. A focused preparation plan identifies the decision under review, the evidence capable of changing it, the requested outcome, and the procedural steps necessary for the tribunal to consider the matter.
