Defending an owner against a compliance application

Defends a unit owner facing a corporation's court or tribunal application over rental, pet, noise or alteration issues.

Many condominium disputes must go to mediation and arbitration or to the Condominium Authority Tribunal before court; the lawyer confirms the steps and timing in writing. Ontario Done by an Ontario lawyer, by referral

  • Advises on the risk of being ordered to pay the other side's legal costs

What is not included

  • Appeals, or tribunal or court steps not covered by the lawyer's written retainer

Information to have ready

  1. 1The declaration, by-laws and rules
  2. 2All letters, notices and emails in the dispute
  3. 3Photos, videos or reports, such as leak or noise records
  4. 4Any chargeback or invoice in dispute

How a referral works

  1. 1Tell us in a few words what the matter is about, and who else is involved, so we can check for a conflict of interest.
  2. 2We recommend an Ontario lawyer for your matter, and at least one other you could choose instead.
  3. 3The lawyer runs their own conflict check, confirms the scope and quotes the fee, normally in a written retainer agreement.
  4. 4You pay the lawyer's fee to the lawyer. Any referral fee comes out of it, is disclosed to you in writing, and never increases what you pay.

Frequently asked questions

What does the lawyer charge?

Lawyers usually charge $300–$650/hr for this kind of work, by the hour. The lawyer quotes the actual rate and an estimate. You pay the lawyer directly; the referral itself costs you nothing.

What does the Condominium Authority Tribunal handle?

It is an online tribunal for certain condominium disputes, such as records requests and some issues with pets, vehicles, parking, storage, noise and other nuisances. Other disputes may go to mediation and arbitration or to court.

Should I stop paying common expenses during a dispute?

Usually not. Unpaid common expenses can lead to a lien on your unit even while you dispute something else, so get advice before withholding any payment.
