Does WSIB Cover Mental Health?
Yes. Since 2018, Ontario's WSIB provides coverage for mental health conditions that arise out of and in the course of employment. These claims generally fall into two categories:
1. Traumatic Mental Stress
This occurs when a worker experiences or witnesses a sudden, shocking, or traumatic event at work (e.g., a robbery, a horrific accident, or a direct death threat).
- Requirement — The event must be identifiable and objectively traumatic.
- Diagnosis — A diagnosis from a regulated health professional (usually a psychologist or psychiatrist) is required.
2. Chronic Mental Stress
This covers conditions like anxiety or depression caused by a prolonged situation at work, such as workplace harassment or bullying.
- Bullying & Harassment — The most common basis for chronic stress claims.
- Exclusion — WSIB does NOT cover stress caused by "management actions" such as performance reviews, transfers, or terminations, unless they are conducted in a harassing or abusive manner.
PTSD for First Responders: Police, paramedics, and firefighters have "presumptive coverage" for PTSD, meaning it is assumed to be work-related unless proven otherwise.
How to File a Claim
- Seek Medical Care — Visit a doctor or psychologist immediately and ensure they record that the stress is work-related.
- Report to Employer — Inform your employer of the injury (mental health injuries are still "injuries").
- File Form 6 — Complete the Worker’s Report of Injury/Disease with WSIB.
