WSIB Appeals: Challenging a Decision

When to Appeal

If you disagree with a WSIB decision regarding your claim, you have the right to appeal. Common grounds for appeal include:

  • Claim Denial — If the WSIB says your injury or illness is not work-related.
  • Benefit Amount — If the WSIB says you are entitled to less compensation than you deserve.
  • Work Readiness — If the WSIB says you are ready to return to work before you feel capable.

The Appeal Process

  • Notice of Objection — File within 6 months of the decision (or 30 days for return-to-work or work reintegration issues).
  • Internal Review — A WSIB Appeals Officer reviews the decision and can uphold, change, or reverse it.
  • Workplace Safety and Insurance Appeals Tribunal (WSIAT) — If you are still unhappy, you can appeal to the independent WSIAT.
