In Ontario, the Consumer Protection Act (CPA) provides clear rules regarding goods or services that you did not request. If a business sends you something you didn't order, you generally have no legal obligation to pay for it or return it.
Key Rules for Unsolicited Goods
- No Payment Required — You are not required to pay for any unsolicited goods or services.
- Right to Keep — You can keep, use, or discard the items as you see fit.
- No Duty to Return — You are not responsible for the cost of shipping the item back to the sender.
What Qualifies as "Unsolicited"?
Goods are considered unsolicited if they are supplied to a consumer who did not request them. This includes:
- Items sent by mail that were never ordered.
- Services performed at your home without your prior consent.
- Substitute goods that are significantly different from what you ordered (unless you agreed to the substitution).
Important Exception: If you receive goods by mistake (e.g., a package intended for your neighbor delivered to your address), these are not unsolicited goods. You have a duty to ensure they reach the correct recipient or the sender.
