Filing a Defence in Small Claims Court

If you have been served with a Plaintiff's Claim, you must act quickly. In Ontario, you have 20 calendar days to file a Defence.

Steps to File Your Defence

  1. Complete Form 9A (Defence): Address each allegation in the Plaintiff's Claim. You can admit, deny, or state you have no knowledge of each point.
  2. Gather Evidence: Attach any documents (contracts, receipts, photos) that support your version of events.
  3. File the Form: You can file online through the Small Claims Court portal or in person at the courthouse where the claim was started.
  4. Serve the Plaintiff: You must provide a copy of your filed Defence to the Plaintiff and any other parties.

The 20-Day Rule

If you miss the deadline, the Plaintiff can ask for Default Judgment. This means they win automatically without a trial. If you need more time, contact the Plaintiff to ask for an extension in writing.
