The Purpose of the Conference

The Settlement Conference (often called a pre-trial) is a mandatory step in Small Claims Court designed to encourage parties to resolve the dispute before trial.

  • Informal Setting — Usually held in a small conference room or via Zoom with a judge or referee.
  • Confidentiality — Discussions are 'without prejudice,' meaning you can't use what's said as evidence at trial.
  • Judge's Opinion — The judge will often give a non-binding opinion on the strengths and weaknesses of each side.

How to Prepare

  • Bring All Evidence — You must bring all documents you intend to rely on at trial.
  • Identify Your Bottom Line — Know the minimum you are willing to accept or the maximum you are willing to pay.
  • List of Issues — Be ready to clearly state what you agree on and what you don't.
