Winning in court is only half the battle. If the debtor refuses to pay, you must take active steps to enforce the judgment.
Enforcement Methods
- Wage Garnishment — Diverting up to 20% of the debtor's wages directly from their employer.
- Bank Account Garnishment — Seizing funds directly from the debtor's bank account.
- Writ of Seizure and Sale — Placing a lien on the debtor's property (land or personal goods).
- Examination in Aid of Execution — Forcing the debtor to appear in court and disclose their assets under oath.
The 20-Day Rule
You generally cannot start enforcement until 20 days after the judgment is issued, allowing the debtor time to pay voluntarily or file an appeal.
