A denied ODSP application is not the end. Ontario has a two-stage appeal process, and with strong medical evidence and proper representation, many denials are successfully overturned.
Why ODSP Applications Are Denied
- Insufficient medical documentation — the Disability Determination Package (DDP) is incomplete or vague
- The condition is not considered "substantially restricting" to daily activities
- Income or assets exceed program limits
- Failure to meet the continuous/recurrent threshold (expected to last one year)
- Administrative errors or missing forms
Step 1: Internal Review (Mandatory)
Before appealing to the Social Benefits Tribunal, you must request an internal review from the ODSP office that denied you.
You have 30 days from the denial letter to request an internal review. Submit in writing with any new or additional medical documentation.
The internal review is your best chance to submit stronger medical evidence and have a different officer reconsider the decision — without the time and cost of a tribunal hearing.
Step 2: Social Benefits Tribunal (SBT) Appeal
If your internal review is denied, appeal to the Social Benefits Tribunal (SBT)— an independent adjudicative tribunal — within 30 days of the internal review decision.
The SBT hearing process:
- Pre-Hearing: Exchange of documents between you and ODSP. Update medical evidence and prepare your submissions.
- Hearing: You present evidence and testimony. ODSP presents their case. Both sides cross-examine and make closing submissions.
- Decision: Written decision issued within weeks to months. If approved, benefits are retroactive to your original application date.
Tips for a Successful ODSP Appeal
- Get specialist letters — specialist reports carry more weight than GP notes alone
- Document functional limitations specifically — describe what you cannot do, not just your diagnosis
- Document bad days, not just good ones — many disabilities are episodic
- Don't miss the 30-day deadlines — for both the internal review and SBT appeal
Retroactive Benefits
If you win your SBT appeal, ODSP pays benefits retroactively to your original application date. For someone who has waited 6–18 months through the appeal process, this can be a substantial lump sum.
