N5 Notice: Interference with Enjoyment

The N5 Notice is served when a landlord believes a tenant is interfering with the reasonable enjoyment of the residential complex or is behaving in a way that is disruptive.

Correction Period

The termination period for an N5 notice is 20 calendar days. The notice must include a 7-day correction period. This means that if the tenant corrects the behaviour within 7 days, the notice is void.

Grounds for an N5 Notice

  • Noise: Constant loud music, shouting, or parties.
  • Conduct: Verbal or physical harassment of other tenants or the landlord.
  • Illegal Activities: Although illegal acts usually fall under an N6, they can also be included in an N5 if they interfere with other tenants' enjoyment.

How to Defend Against an N5 Notice

If you receive an N5, you have the right to attend an LTB hearing. You can present evidence that the allegations are false or that you have corrected the behaviour within the 7-day period.
