N4 Notice: Rent Not Paid

The N4 Notice is the most common eviction notice in Ontario. It is served when a tenant has failed to pay their rent on time.

Termination Period

The termination period for an N4 notice is 14 calendar days (or 7 days if the tenancy is on a weekly basis). This period starts the day after you serve the notice.

How to Void the Notice

The tenant can void the notice by paying all rent arrears before the termination date. If they pay, the notice is cancelled, and the landlord cannot file an application with the LTB.

Important Rules for Landlords

  • Serve Correctly: Use registered mail, personal service, or courier. E-mail is only allowed if it's specifically agreed upon in the lease.
  • Don't Forget the Day of Service: Do not include the day you serve the notice in the 14-day calculation.
  • File an L1 Application: If the tenant does not pay and does not leave, you must file an L1 application with the LTB.
