N12 Notice: Landlord's Own Use

When to Use the N12

The N12 is used when a landlord, their spouse, children, parents, or a caregiver intends to move into the rental unit for at least one year.

Key Requirements

  • 60-Day Notice — The termination date must be at least 60 days after the notice is served and on the last day of a rental period.
  • One Month's Compensation — Landlords must pay the tenant one month's rent before the termination date.
  • Good Faith — The landlord must truly intend to occupy the unit for at least 12 months.

Tenant Rights

Tenants do not have to move out just because an N12 is served. They have the right to a hearing before the Landlord and Tenant Board (LTB).
