The Landlord's Duty to Repair

Under the Residential Tenancies Act (RTA), landlords are responsible for maintaining a residential complex and each rental unit in a good state of repair and fit for habitation.

  • Habitability — Heat, water, and electricity must be maintained.
  • Health and Safety — Mould, pests, and structural issues must be addressed.
  • Bylaw Compliance — The unit must meet local property standards.

What Tenants Can Do

  1. Notify the Landlord — Always provide written notice of the issue.
  2. File a T6 Application — If the landlord fails to repair, you can apply to the LTB for an order to repair and a rent abatement.
  3. File a T2 Application — If the lack of repair interferes with your reasonable enjoyment of the unit.
