Your Legal Duties at an Accident
Under the Highway Traffic Act, you must immediately stop at the scene if you are involved in an accident that causes injury or property damage.
- Provide Information — You must provide your name, address, insurance info, and licence number to the other party.
- Render Assistance — If anyone is injured, you must offer reasonable assistance.
- Police Report — If damage exceeds $2,000 or there is an injury, you must report it to the police.
The Penalties
- First Conviction — Fine up to $2,000, 6 demerit points, and up to 6 months in jail.
- Licence Suspension — Your driver's licence may be suspended for up to 2 years.
- Insurance Rates — This is considered a 'major' offence and will cause your premiums to spike.
Defence Options
- Necessity — If you had to leave to get medical help for yourself or others.
- Lack of Knowledge — If you were unaware that an accident had even occurred (e.g., a very minor scrape).
- Identification — Challenging the police's identification of you as the driver.
A fail to remain charge is a serious threat to your driving record. We can provide a robust defence.
