Driving without valid automobile insurance in Ontario is one of the most severe traffic offences under the Compulsory Automobile Insurance Act (CAIA). Fines are among the highest in Canada — up to $50,000.
What the Law Requires
Every motor vehicle operated in Ontario must be covered by a valid Ontario automobile insurance policy with at least the mandatory minimum coverage. You must be able to produce proof of insurance on demand by a police officer.
Penalties for Driving Without Insurance

Additionally, you may face:
- A 25% victim fine surcharge on top of the fine
- Vehicle impoundment (up to 15 days on first offence)
- Licence suspension
- Significant increase in future insurance premiums
Common Defences
- Valid insurance existed — Clerical error; lapse in paperwork; insurer failed to notify; policy renewed but proof not yet received
- Due diligence — You genuinely believed the vehicle was insured and took reasonable steps to confirm
- Wrong person charged — You were not the owner or operator at the time
- Charter issues — The stop was unlawful or the demand for insurance was not properly made
Minimum Fine is $5,000: Even for a first offence, judges have very little discretion to go below the statutory minimum. This is why fighting the charge — or at least seeking an amendment — is almost always worthwhile.
What to Do If Charged
- Do not simply pay the fine — this registers a conviction.
- Gather all insurance documents — renewal letters, auto-pay records, insurer correspondence.
- Contact your insurance broker or insurer immediately for confirmation of coverage.
- Retain a paralegal to attend court, negotiate with the prosecutor, and present your defence.
15-Day Response Deadline: You must respond to the certificate of offence within 15 days. If you do nothing, a conviction is registered and the minimum fine is immediately owing.
