Contesting a Will in Ontario

When You Can Challenge a Will

Disappointed with your inheritance? In Ontario, you can't challenge a will just because you think it's unfair. You must have valid legal grounds, such as:

  • Lack of Capacity — Proving the person did not have the mental capacity to understand the will.
  • Undue Influence — Showing the person was pressured or coerced into signing the will.
  • Improper Execution — Proving the will was not properly signed and witnessed.
  • Dependency Support — Proving you were a dependent and the will did not provide adequately for you.
