Unfair Practices
The CPA prohibits these common tactics:
- Charging more than the advertised price
- Bait-and-switch advertising
- Using exaggerated or misleading product claims
- Taking advantage of a consumer's inability to protect their interests
- Charging for a service not requested or authorized
Remedies for Unfair Practices: If a business used an unfair practice, you may be able to rescind (cancel) the agreement within one year of entering it, even if no cooling-off period applies.
Home Renovation Contracts
Contracts for home renovations over $50 must be in writing and include specific information about the work, cost, timeline, and your right to cancel. Verbal agreements or contracts missing required details can be cancelled.
How to Cancel a Contract
- Send written notice by email, fax, or registered mail to the business.
- Keep a copy of your cancellation notice and proof of delivery.
- The business must refund you within 15 days of receiving your cancellation.
- If no refund is provided, file a complaint with Consumer Protection Ontario or pursue the matter in Small Claims Court.
