Two Professions, One Goal
In Ontario, both lawyers and paralegals are licensed by the Law Society of Ontario (LSO). Both can provide legal services and represent you in court.
- Lawyers — Have a 'general' scope of practice, meaning they can handle any legal matter (criminal, family, civil, estate).
- Paralegals — Have a 'limited' scope of practice, focusing on specific courts and tribunals (LTB, Small Claims, HTA, Human Rights).
The Differences
- The Cost — Paralegals generally have lower hourly rates and more fixed-fee options.
- The Expertise — Paralegals often specialize in one or two areas of law (like LTB or Traffic), making them highly skilled in those fields.
- The Education — Lawyers attend law school and articling. Paralegals attend an accredited paralegal program and complete a field placement.
When to Hire a Paralegal
- Landlord & Tenant — Evictions, rent increases, and repair disputes.
- Small Claims Court — Debts, contract disputes, and property damage up to $35,000.
- Traffic Tickets — Speeding, stunt driving, and HTA offences.
- Employment Law — Wrongful dismissal and HRTO complaints.
- Notary Services — Affidavits, declarations, and certified true copies.
