Choosing Between a Lawyer and a Paralegal

Two Professions, One Goal

In Ontario, both lawyers and paralegals are licensed by the Law Society of Ontario (LSO). Both can provide legal services and represent you in court.

  • Lawyers — Have a 'general' scope of practice, meaning they can handle any legal matter (criminal, family, civil, estate).
  • Paralegals — Have a 'limited' scope of practice, focusing on specific courts and tribunals (LTB, Small Claims, HTA, Human Rights).

The Differences

  • The Cost — Paralegals generally have lower hourly rates and more fixed-fee options.
  • The Expertise — Paralegals often specialize in one or two areas of law (like LTB or Traffic), making them highly skilled in those fields.
  • The Education — Lawyers attend law school and articling. Paralegals attend an accredited paralegal program and complete a field placement.

When to Hire a Paralegal

  • Landlord & Tenant — Evictions, rent increases, and repair disputes.
  • Small Claims Court — Debts, contract disputes, and property damage up to $35,000.
  • Traffic Tickets — Speeding, stunt driving, and HTA offences.
  • Employment Law — Wrongful dismissal and HRTO complaints.
  • Notary Services — Affidavits, declarations, and certified true copies.

Unsure if a paralegal can handle your case? Our LSO-licensed paralegals can help you find the right path.
